The decision in brief

Underwrite voucher leasing from the actual approved rent, tenant share, assistance contract, inspection status and payment start. A payment standard or advertised rent is not a guaranteed owner receipt.

Work through this decision

  1. Review DCHA's current landlord process and program documents.
  2. Prepare a compliant unit and submit the required leasing package.
  3. Reconcile the executed lease, HAP contract, tenant portion and actual collections.

Evidence to collect

EvidenceHow to use it
RFTA and inspection track acceptance, deficiencies and approval.
HAP contract verify assistance amount, effective date and obligations.
Screening apply lawful criteria and source-of-income protections.

The mistake to catch before committing

DCHA identifies HAP as its contractual portion of rent. Do not add HAP to the full contract rent as extra income or assume subsidy eliminates vacancy, maintenance or compliance risk.

Separate rent regulation, registration and the right to possession

DHCD distinguishes rent stabilization from other tenant protections. A rent-control exemption is not a general exemption from DC landlord obligations. DHCD states rental units must be registered as covered or exempt; registration and a housing business license are separate records. Obtain the actual exemption filing and ownership facts instead of accepting “small building” as proof.

For an occupied acquisition, reconcile each lease, amendments, deposit liability, rent ledger, notices, subsidy agreements and unresolved repair claims. Underwrite the rent that is lawfully collectible and supported by records. Do not model a rent reset, move-out or renovation vacancy as certain merely because ownership changes.

Income caseWhat it means
In-placeVerified contract rent and actual collections, with existing obligations
Lawful changeA documented permissible change with required notices and timing
Potential market rentA separate hypothesis requiring rent evidence and legal feasibility

Ask DC counsel to resolve conflicting ownership, exemption, notice or possession facts before relying on them in a closing or refinance deadline. The RENTAL Act amended the legal framework; an older checklist may not capture the current branch.
